Temporary Residence
Types of Temporary Residence Permits
1. Visitor Visa (Temporary Resident Visa - TRV)
If you are not from a visa-exempt country, you will need a Visitor Visa to enter Canada. This visa is typically valid for up to 6 months and allows you to visit friends and family, explore Canada's beautiful landscapes, or conduct short-term business activities.
2. Electronic Travel Authorization (eTA)
Citizens of visa-exempt countries (e.g., the United States, European Union countries) may need an eTA instead of a Visitor Visa. An eTA is electronically linked to your passport and allows for multiple entries into Canada over a 5-year period or until your passport expires.
3. Study Permit
If you plan to study in Canada for more than 6 months, you will need a study permit. This permit allows you to attend a designated learning institution and may also allow you to work part-time on campus.
4. Work Permit
A work permit is required if you plan to work temporarily in Canada. Whether you are coming for a specific job or through an international agreement, understanding the specific requirements and eligibility criteria is essential.
5. Temporary Resident Permit (TRP)
If you're ineligible for a TRV but have a compelling reason to enter Canada, you may be able to apply for a TRP. However, this is a complex process, and consulting with an immigration lawyer is recommended.
6. Extending Your Stay
If your circumstances change and you need to stay longer, you may be able to apply to extend your TRV from within Canada.

Express Entry is Canada's popular system for skilled workers. You create an online profile highlighting your skills, education, work experience, and language abilities (English or French). If you meet the minimum requirements, you enter a pool of candidates. The Immigration, Refugees and Citizenship Canada (IRCC) then invites applicants with the highest points to apply for PR.
2. Provincial Nominee Programs (PNPs)
PNPs offer a more targeted route to PR. Each Canadian province prioritizes skills needed in their specific job market. Explore PNP options that align with your qualifications and preferred location. Some PNPs even offer fast-tracked processing times.
3. Alternative Routes to Consider

Citizenship
Eligibility Requirements
1. Permanent Resident Status
You must have permanent resident (PR) status in Canada and not be under any removal order.
2. Residency Requirement
You need to have lived in Canada for at least 1,095 days (3 years) out of the 5 years before applying.
3. Tax Filing
You must have filed your taxes for at least 3 years within the 5-year period
4. Language Skill
Applicants aged 18-54 must demonstrate proficiency in either English or French.
5. Knowledge of Canada
You will need to pass a citizenship test covering Canadian history, values, institutions, and symbols.

Canada's refugee protection system is designed to offer a lifeline to those who need it most. With a strong commitment to upholding human rights and providing safe refuge, Canada continues to be a beacon of hope for refugees worldwide.
You may be eligible for refugee protection in Canada if you meet the criteria under one of the following categories:
1. Convention Refugee
You are outside your home country and cannot return due to a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group.
2. Person in Need of Protection
You are in Canada and unable to return to your home country safely due to a risk of torture, risk to life, or risk of cruel and unusual treatment or punishment.

Ensuring Fairness and Justice
Refugee Appeal Division (RAD)
In Canada, refugees who have had their claims denied have the right to appeal the decision. The appeal process is designed to ensure fairness and justice, providing an opportunity for rejected claimants to present new evidence or highlight errors in the original decision.
Immigration Appeal Division (IAD)
1. Sponsorship Appeals
Refused application to sponsor a family member for permanent residency
2. Removal Order Appeals
A permanent resident, protected person, or a foreign national with a permanent resident visa who has been issued a removal order by CBSA
3. Residency Obligation Appeals
Permanent residents who have been found not to have met their residency obligations
4. Minister’s Appeal
The Minister of Public Safety can appeal an IRB decision that allowed a person to stay in Canada despite a removal order.

Judicial Review
If your Temporary Resident Visa (TRV) application to Canada has been refused, you might feel disheartened. However, if you believe the refusal was unjust or based on an error, you have the option to appeal the decision to the Federal Court of Canada through a process known as Judicial Review.
Judicial review is a legal process where a judge reviews the decision made by the Immigration, Refugees and Citizenship Canada (IRCC) to ensure it was fair and lawful. This process does not re-evaluate the merits of your application but focuses on whether the decision was made in accordance with legal principles.
